As previously reported, H.R.8337 – Continuing Appropriations Act, 2021 and Other Extensions Act, signed into law on October 1, allows USCIS to increase the fees for premium processing.
On Friday, October 16, USCIS announced that from Monday, October 19, the agency’s fee increases would go into effect. H.R.8337 increases the fees as follows:
- Form I-907, Request for Premium Processing, from $1,440 to $2,500
- Form I-129, Petition for a Nonimmigrant Worker, requesting H-2B or R-1 nonimmigrant status, from $1,440 to $1,500
USCIS will reject any Form I-907 postmarked on or after October 19 that doesn’t include the new ($2,500) fee amount. H.R.8337 also indicates that USCIS will be able to expand premium processing for other forms and benefits, but USCIS has not done so at this time.
