USCIS Provides Guidance for Implementing New Law Related to Foreign Workers on Guam, Northern Mariana Islands

USCIS has published a new policy providing guidelines on the National Defense Authorization Act for Fiscal Year 2018, which in part, allows certain H-2B workers on the Northern Mariana Islands and Guam to qualify for an exemption to the “temporary need” requirement if they begin employment on or before December 30, 2023. Workers employed in particular healthcare positions, as well as workers directly associated with the planned military alignment of Marines from Okinawa, Japan to Guam, will qualify for the exemption.
