USCIS Issues Updated TPS Guidance for Haiti and Syria, Superseding Earlier Employer Instructions

USCIS has issued updated Form I‑9 Central guidance in late March 2026 for Temporary Protected Status (TPS) beneficiaries from both Haiti and Syria, aligning employer compliance instructions following court‑ordered stays of TPS terminations. These updates supersede earlier USCIS guidance that EIG previously reported for each country.

Under the most recent USCIS notices, the same Form I‑9 and E‑Verify instructions now apply to both Haiti and Syria.

Employer Guidance for TPS Haiti and Syria

Pursuant to court orders, USCIS confirms that certain Employment Authorization Documents (EADs) issued to TPS beneficiaries from Haiti and Syria are administratively extended through July 1, 2026 for Form I‑9 and E‑Verify purposes.

For affected TPS Haiti and Syria employees, employers must:

  • Enter “as per court order” in Form I‑9, Section 1
  • Record July 1, 2026 as the expiration date in Form I‑9, Section 2
  • Use July 1, 2026 as the employment authorization expiration date in E‑Verify
  • Include a note in the Additional Information field referencing the court‑ordered extension
  • Retain the most recent USCIS Form I‑9 Central alert with the employee’s I‑9 documentation
