Just one week after USCIS issued guidance extending employment authorization deadlines following the Supreme Court’s decision in Mullin v. Doe, the agency has released updated country-specific guidance for individuals with Temporary Protected Status (TPS) from Burma, Ethiopia, Somalia, Yemen, South Sudan, and Syria.
The July 17 guidance supersedes USCIS alerts issued on July 10 and provides revised Form I-9 and E-Verify instructions for employers and TPS beneficiaries affected by ongoing litigation surrounding TPS termination decisions.
Updated TPS Employment Authorization Dates
Burma (Myanmar)
USCIS states that TPS-related Employment Authorization Documents (EADs) with original expiration dates of:
- November 25, 2025
- May 25, 2024
- November 25, 2022
remain valid pursuant to court order.
For Form I-9 purposes:
- Section 1 should state: “as per court order”
- Section 2 expiration date should be: July 27, 2026
Employers should use July 27, 2026 when creating E-Verify cases.
Ethiopia
EADs issued under Ethiopia’s TPS designation with original expiration dates of:
- June 12, 2024
- December 12, 2025
remain valid pursuant to court order.
For Form I-9 and E-Verify purposes, employers should use: July 30, 2026
Somalia
EADs with original expiration dates of:
- March 17, 2023
- September 17, 2024
- March 17, 2026
remain valid under a court-ordered extension.
For Form I-9 and E-Verify purposes, employers should use: July 24, 2026
Yemen
EADs with original expiration dates of:
- March 3, 2026
- September 3, 2024
- March 3, 2023
remain valid pursuant to court order.
For Form I-9 and E-Verify purposes, employers should use: July 24, 2026
South Sudan
EADs with original expiration dates of:
- November 3, 2023
- May 3, 2025
- November 3, 2025
remain valid under existing court orders.
For Form I-9 and E-Verify purposes, employers should use: July 30, 2026
Syria
EADs with original expiration dates of:
- September 30, 2025
- March 31, 2024
- September 30, 2022
- March 31, 2021
remain valid pursuant to court order.
For Form I-9 and E-Verify purposes, employers should use: July 24, 2026
Updated Form I-9 Guidance
USCIS instructs employers completing Form I-9s for affected TPS beneficiaries to:
- Enter “as per court order” in the employee expiration date field in Section 1.
- Record the applicable country-specific extension date in Section 2.
- Add an explanatory note in the Additional Information field.
- Use the same extension date when creating or updating E-Verify records.
USCIS also recommends that employers retain copies of the relevant USCIS alert and TPS webpage with Form I-9 records.
