USCIS has released additional Temporary Protected Status (TPS) guidance affecting beneficiaries from Ukraine, El Salvador, and Sudan. The announcements supplement previous USCIS updates and provide automatic Employment Authorization Document (EAD) extensions for certain TPS beneficiaries whose documents expire before the end of their respective TPS designation periods.
Ukraine TPS: Automatic EAD Extension Through October 19, 2026
USCIS announced that Ukraine’s TPS designation and related benefits remain scheduled to terminate on October 19, 2026. To prevent interruptions in employment authorization, USCIS is sending notices to certain Ukraine TPS beneficiaries who:
- Filed Form I-765 during one of the most recent TPS re-registration periods;
- Continue to be eligible for TPS benefits; and
- Received an Employment Authorization Document (EAD) under category A12 or C19 that expires before October 19, 2026.
For these individuals, USCIS is automatically extending qualifying TPS-based EADs through October 19, 2026.
Eligible Ukraine EADs
Affected employees may present the following documents as List A evidence of identity and employment authorization through October 19, 2026:
- An EAD with an expiration date on or after April 20, 2026, and before October 19, 2026; and
- The USCIS notice confirming the automatic extension.
Form I-9 and E-Verify Guidance
Employers should:
- Enter October 19, 2026 as the employment authorization expiration date in Sections 1 and 2 of Form I-9.
- Record the extension information in the Additional Information field.
- Retain the USCIS extension notice with Form I-9 documentation.
- Use October 19, 2026 as the expiration date when creating or updating E-Verify cases.
El Salvador TPS: Automatic EAD Extension Through September 9, 2026
USCIS also issued guidance regarding the upcoming termination of TPS benefits for El Salvador. The TPS designation and related benefits are scheduled to terminate on September 9, 2026.
USCIS is sending notices to eligible TPS beneficiaries who:
- Filed Form I-765 during a recent TPS re-registration period;
- Continue to qualify for TPS protections; and
- Hold an EAD under category A12 or C19 that expires before September 9, 2026.
These notices confirm that qualifying TPS-based EADs are automatically extended through September 9, 2026.
Eligible El Salvador EADs
Eligible employees may present:
- An EAD with an expiration date on or after March 9, 2026, and before September 9, 2026; and
- The USCIS notice extending employment authorization.
Together, these documents are acceptable List A evidence for Form I-9 purposes through September 9, 2026.
Form I-9 and E-Verify Guidance
Employers should:
- Enter September 9, 2026 in the expiration date fields of Form I-9.
- Annotate the extension in the Additional Information field.
- Retain supporting USCIS documentation with Form I-9 records.
- Use September 9, 2026 as the expiration date in E-Verify.
Sudan TPS: Automatic EAD Extension Through October 19, 2026
USCIS has likewise provided updated guidance for Sudan TPS beneficiaries. Sudan’s TPS designation and related protections are scheduled to terminate on October 19, 2026.
To help avoid employment authorization gaps, USCIS is issuing notices to certain Sudan TPS beneficiaries who:
- Filed Form I-765 for TPS-related work authorization;
- Remain eligible for TPS benefits; and
- Hold an EAD issued under category A12 or C19 that expires before October 19, 2026.
These individuals will receive notification that their TPS-based EADs are automatically extended through October 19, 2026.
Eligible Sudan EADs
Affected workers may present:
- An EAD with an expiration date on or after July 22, 2026, and before October 19, 2026; and
- The USCIS extension notice.
This document combination serves as valid List A evidence of identity and employment authorization through October 19, 2026.
Form I-9 and E-Verify Guidance
Employers should:
- Enter October 19, 2026 in the applicable Form I-9 expiration date fields.
- Note the extension in the Additional Information section.
- Retain the USCIS notice with the employee’s Form I-9 records.
- Use October 19, 2026 as the expiration date in E-Verify.
