USCIS Conducts Third Random Selection of Previously Submitted FY 2022 H-1B Cap Registrations

The United States Citizenship and Immigration Services (USCIS) on November 19 selected additional registrations to reach the Fiscal Year (FY) 2022 H-1B numerical allocations. The selections are from previously submitted electronic registrations using a random selection process.

The petition filing period for the registrations selected on November 19 will begin on November 22, 2021, and close on February 23, 2022. Individuals whose registrations were selected will see an update on their myUSCIS accounts, including the selection notice and details about when and where to file.

This is the third random selection for FY2022. The second round was selected in July and the filing period ended on November 3, 2021.

Erickson Insights

Employers submitted H-1B cap registrations for 308,613 workers for FY22. USCIS uses historical data to calculate the number of registrations needed to meet the H-1B cap for a given fiscal year. For FY22, USCIS did not receive the expected volume of H-1B cap petitions, necessitating the second and third lotteries. The initial filing period for those with selected registrations for FY 2022 was from April 1, 2021, through June 30, 2021.
