US Supreme Court Says Self-Removal Deadlines Don’t Apply to Weekends or Holidays

The US Supreme Court ruled on April 22, 2025, that individuals who have a self-deportation deadline which terminates on a weekend or a federal holiday may move to reopen their removal cases the following business day. This 5-4 decision, reverses a Tenth Circuit decision.

Voluntary departure is discretionary relief granted to noncitizens who get an unfavorable decision in their removal cases, but who are found to have “good moral character.”

Individuals who file a motion for reconsideration during the 60-day window for departure can avoid a financial penalty and a 10-year bar on various forms of immigration relief.
