On February 3, 2026, the American Association of University Professors filed a lawsuit against the Department of Homeland Security (DHS) arguing that the Gold Card Visa Program, a new immigration initiative offering a direct pathway to US permanent residency and citizenship for qualified applicants, violates the Administrative Procedure Act and the Immigration and Nationality Act, and that it was enacted without statutory authority.
The complaint was filed in the US District Court for the District of Columbia.
