USCIS Issues Guidance on Adjustment of Status by Aliens Whose Conditional Permanent Residence Has Been Terminated

USCIS released guidance on November 21, 2019, which clarifies when the Service may adjust the status of an alien whose Conditional Permanent Resident (CPR) status has been terminated. This guidance applies to the adjustment of status applications filed with USCIS after November 21, 2019. A CPR receives a green card valid for 2 years and an alien with such status is generally unable to adjust their status on a new basis unless their status has been terminated and all of the following requirements are met: (1) the alien has a new basis for adjustment of status; (2) the alien is otherwise eligible to adjust status; and (3) USCIS has jurisdiction over the adjustment of status application.
