On December 7, 2023 the Danish Parliament passed an amendment to the Aliens Act that can result in revocation of a residence permit if a refugee with a temporary residence permit at some point travels to their home country after the new rules comes into effect on January 1, 2024.
Under the new rule, the Immigration Service will assume that the individual no longer risks persecution in their home country. This will apply no matter how long they have had a temporary residence permit in Denmark. Previously the temporary residence permit was revoked if a refugee traveled to their home country within 10 years after they got a residence permit as a refugee for the first time. This 10 years limit is cancelled with the new rules.
The new rules come into effect on January 1, 2024, and they only apply to travel started after the rules come into effect.
Refugees with permanent residence permits are not affected by the new rules. A permanent residence permit can still only be revoked due to travel to the refugee’s home country within 10 years after they got a residence permit as a refugee for the first time.
