Biden Administration Issues Memo Terminating the Migrant Protection Protocols, Remain in Mexico Program

Department of Homeland Security Secretary Alejandro Mayorkas issued a memo that renews the Biden’s administration’s aim of ending the Trump administration’s Migrant Protection Protocols program, also known as Remain in Mexico.

Introduced by the Trump administration, MPP required asylum seekers to stay in Mexico while they wait for their court hearing.

DHS officials told reporters that this memo addresses the issues from the previous memo. The new memo cannot go into effect until the court order is lifted.

Background

The Biden administration suspended MPP in January 2021, and then attempted to formally end the program in June 2021. In August, they were ordered to restart the program by a federal judge who said the administration failed to follow proper protocol. The Supreme Court denied the Biden administration’s request to block the ruling.

Still, to keep in compliance with the judge’s ruling, the White House is preparing to reinstate MPP in November.
