Update: Starting Tuesday, March 12, premium processing will again be available for all H-1B petitions. This encompasses all H-1B petitions including change of employer petitions, amendments, extensions, and, as of now, H-1B FY2020 CAP petitions.
More changes possible in coming weeks and months: EIG will continue to monitor H-1B Premium Processing availability, which has been modified five times in the last year. Notably, last year USCIS announced the suspension of Premium Processing for FY2019 CAP cases on March 20, 2018, less than two weeks before the start of the FY2019 CAP filing window.
Next Step: EIG will be contacting clients with information about cases now eligible for upgrades and will be following up with HR and Global Mobility teams regarding eligible employees.
