USCIS has issued updated guidance for Burma (Myanmar) and Somalia TPS beneficiaries, extending the validity of certain Employment Authorization Documents (EADs) under ongoing federal court orders. The latest announcements supersede guidance issued in late July and provide short-term extensions while litigation concerning TPS terminations continues.
Burma TPS: EADs Extended Through August 7, 2026
Under the court order, TPS Burma EADs with original expiration dates of:
- November 25, 2022
- May 25, 2024
- November 25, 2025
remain valid through August 7, 2026 under the court order.
Form I-9 and E-Verify Instructions for Burma
For affected TPS Burma beneficiaries:
- Enter “as per court order” in the expiration date field in Section 1 of Form I-9.
- Employers should enter August 7, 2026 in Section 2 and include a notation in the Additional Information field.
- For E-Verify cases, employers should use August 7, 2026 as the work authorization expiration date.
Somalia TPS: EADs Extended Through August 5, 2026
Under the court order, TPS Somalia EADs with original expiration dates of:
- March 17, 2023
- September 17, 2024
- March 17, 2026
remain valid through August 10, 2026.
Form I-9 and E-Verify Instructions for Somalia
For affected TPS Somalia beneficiaries:
- Employees should enter “as per court order” in Section 1 of Form I-9.
- Employers should enter August 10, 2026 in Section 2 and note the extension in the Additional Information field.
- E-Verify cases should reflect an expiration date of August 10, 2026.
