USCIS has issued updated policy guidance in line with the vacatur of the EB-5 Modernization Rule and the EB-5 Reform and Integrity Act of 2022. The updated guidance removes provisions that were part of the now vacated rule, clarifies that an applicant may file a green card application concurrently with their petition, revises the investment amounts and targeted employment area designation process, and makes additional technical changes.
