US | Extension to Interim I-9 Compliance Flexibility

On October 11, Immigration and Customs Enforcement (ICE) announced an extension of Form I-9 flexibilities. The announcement extends the policies established in March 2020 during the beginning of the COVID-19 pandemic and extends them through July 31, 2023. The extension also gives DHS time to finalize the proposed regulation published in August. The proposed rule authorizes the DHS Secretary to establish alternative options for document examination procedures through a pilot program.

Comments on the rule are due on October 17, 2022, and can be submitted using the Federal Register portal here. In particular, DHS seeks comments on document retention practices, fraudulent documents, and anti-discrimination training.
