On Friday, April 1, the Centers for Disease Control (CDC) announced it would terminate an Order under 42 U.S.C. §§ 265, 268, and 42 C.F.R. § 71.40 (i.e., “Title 42”). The “Title 42” policy, implemented during the COVID-19 pandemic, prevented migrants from entering the United States.
According to the announcement, Title 42 will officially end on May 23, 2022. This period will allow DHS to implement appropriate COVID-19 mitigation protocol and prepare for the return of regular migration patterns.

The anticipated end of the Title 42 policy will likely produce a dramatic increase in migrants traveling to the southern border. According to reports, the administration estimates that about 170,000 migrants will travel to the border, in addition to the approximate 25,000 that are already waiting in Mexican border camps. This estimate has raised alarms internally about an expected “mass migration event,” leading CBP to solicit volunteers to assist in the effort and set up an interagency “Southern Border Coordination Center” in preparation for the influx.
