Thailand Updates BOI Work Permit Rules for Foreign Workers

On June 5, 2025, the Board of Investment (BOI) published Notification No. Por. 8/2568, which contains updated guidelines for BOI-promoted companies obtaining work permits for foreign nationals.

The new requirements do not apply to short-term positions (up to six months).

The notification establishes new minimum monthly salary requirements for foreign employees of BOI companies. Executives must earn at least THB 150,000/month; managers, engineers, IT specialists and researchers must earn THB 75,000 (or THB 50,000 with a relevant degree).

Initial applications must be supported by an employment contract clearly stating the agreed salary; for renewal applications, withholding tax filings must be presented.

In addition, BOI companies in the manufacturing sector with more than 100 employees must demonstrate that Thai nationals constitute at least 70% of the workforce.

The new requirements will take effect in two stages:

  • On October 1, 2025 for BOI promotion certificates issued on or after June 5, 2025;
  • On January 1, 2026 for BOI promotion certificates issued before June 5, 2025.
