Supreme Court to Hear Birthright Citizenship Case on April 1

The Supreme Court is scheduled to hear arguments on the Trump administration’s birthright citizenship executive order on April 1, 2026. The court is expected to issue a ruling in the case by July 2026. 

What they’re saying:

  • The Trump administration argued birthright citizenship should not be extended to children of temporary visa holders or undocumented immigrants, citing a mix of historical references and legal commentaries, which legal scholars argue cherry-pick and distort historical records. 
  • Lower courts around the country have struck down the birthright citizenship executive order, with only one Circuit Court, the Ninth, finding it to be unconstitutional. 
  • Immigration advocates are warning that the Trump Administration’s policy would upend an over 150-year legal precedent, and could result in thousands of stateless babies every year.
