Poland Extends Right to Stay for Ukrainians

The Polish government’s amendment to the Act on Assistance to the Citizens of Ukraine related to the ongoing conflict in Ukraine is waiting for the President’s approval. This is the final step of the legislation process. If approved, the right to stay for Ukrainian nationals residing in Poland due to the war will be extended until September 30, 2025.

The following changes will also be introduced:

  • The term for employer to notify the authorities about commencement of work by Ukrainian national will be shortened from 14 to 7 days;
  • Non-working dependents holding UKR status will be able to submit temporary residence permit applications for family reunion;
  • A new type of electronic residence permit application for Ukrainian nationals residing in Poland due to the war will be offered. Holders of the permit will be exempted from work permit obligation and will be able to open business activity under the same rules as Polish citizens.
New Rules for Non-Working Dependents

Following the moment of introduction of the new rules non-working dependents will be able to submit residence permit applications if holding UKR status. This will be possible for all non-working dependents, including dependents of holders of regular residence permit for the purpose of work.

All Ukrainian nationals holding UKR status will be additionally able to apply for a simplified residence permit if they:

  • held the UKR status on March 4, 2024,
  • hold the UKR status at the moment of submission of application,
  • hold the UKR status uninterruptedly for at least 365 days.

The aim of this new type of electronic residence permit application is to legalize right to stay and issue the documents faster than in regular residence permit processing.

These proposed changes correspond with termination of the EU temporary protection on March 4, 2025. Once implemented, new regulations secure status of Ukrainian nationals residing in Poland beyond the actual period of validity of the EU temporary protection.
