October 2023 Visa Bulletin Released

In the October 2023 Visa Bulletin, Final action dates for EB-1 Worldwide (All Other) will be current. EB-2 and EB-3 Worldwide (All Other) also advance. EB-1, EB-2, and EB-3 final action dates for China advance, as well as EB-1, EB-2, and EB-3 final action dates for India. 

PLEASE NOTE: USCIS has indicated they will accept adjustment of status applications pursuant to Dates of Filing (Chart B) October 2023. For more information, please visit the USCIS website.

Final Action Dates

China:

  • EB-1: Advances with a cut-off date of February 15, 2022.
  • EB-2: Advances with a cut-off date of October 1, 2019.
  • EB-3: Advances with a cut-off date of January 1, 2020.

India:

  • EB-1: Advances with a cut-off date of January 1, 2017.
  • EB-2: Advances with a cut-off date of January 1, 2012.
  • EB-3: Advances with a cut-off date of May 1, 2012.

Others:

  • EB-1: Current for all countries except China and India.
  • EB-2: Worldwide (All Other) advances with a cut-off date of July 8, 2022.
  • EB-3: Worldwide (All Other) advances with a cutoff date of December 1, 2021.
Dates for Filing (Chart B):

China:

  • EB-1: Advances with a cut-off date of August 1, 2022.
  • EB-2: Advances with a cut-off date of January 1, 2020.
  • EB-3: Advances with a cut-off date of September 1, 2020.

India:

  • EB-1: Retrogresses with a cut-off date of July 1, 2019.
  • EB-2: Advances with a cut-off date of May 15, 2012.
  • EB-3: Remains unchanged with a cut-off date of August 1, 2012.

Others:

  • EB-1: Current for all countries except China and India.
  • EB-2: Worldwide (All Other) advances with a cut-off date of January 1, 2023.
  • EB-3: Philippines retrogresses with a cut-off date of January 1, 2023.
  • EB-3: Worldwide (All Other) retrogresses with a cut-off date of February 1, 2023.

Looking Forward

Individuals who are now current should contact EIG to begin work on their Adjustment of Status case(s). If you already have an AOS pending with USCIS, it will not be adjudicated until the Final Action date becomes current. The EIG team closely monitors changes to the monthly visa bulletin and determines the best action plan for each case.
