July 2023 Visa Bulletin Released

In the July 2023 Visa Bulletin, EB-1 Worldwide (All Other) remains current. EB-2 Worldwide final action dates remain unchanged and EB-3 final action dates retrogress by 4 months. EB-1, EB-2, and EB-3 final action dates for China remain unchanged. EB-1 and EB-2 final action dates for India remain unchanged. The EB-3 final action date for India retrogresses 3.5 years.

Final Action Dates (Chart A):

China:

  • EB-1: Remains unchanged with a cut-off date of February 1, 2022.
  • EB-2: Remains unchanged with a cut-off date of June 8, 2019.
  • EB-3: Remains unchanged with a cut-off date of April 1, 2019.

India:

  • EB-1: Remains unchanged with a cut-off date of February 1, 2022.
  • EB-2: Remains unchanged with a cut-off date of January 1, 2011.
  • EB-3: Retrogresses by 3.5 years with a cut-off date of January 1, 2009.

Others:

  • EB-1: Current for all countries except China and India.
  • EB-2: Worldwide (All Other) remains unchanged with a cut-off date of February 15, 2022.
  • EB-3: Worldwide (All Other) retrogresses by 4 months with a cut-off date of February 1, 2022.

China:

  • EB-1: Remains unchanged with a cut-off date of June 1, 2022.
  • EB-2: Remains unchanged with a cut-off date of July 8, 2019.
  • EB-3: Remains unchanged with a cut-off date of June 1, 2019.

India:

  • EB-1: Remains unchanged with a cut-off date of June 1, 2022.
  • EB-2: Remains unchanged with a cut-off date of May 1, 2012.
  • EB-3: Remains unchanged with a cut-off date of August 1, 2012.

Others:

  • EB-1: Current for all countries except China and India.
  • EB-2: Worldwide (All Other) remains unchanged with a cut-off date of December 1, 2022.
  • EB-2: Worldwide (All Other) remains unchanged with a cut-off date of May 1, 2023.

Looking Forward

As reported in previous issues, EIG expects that EB-1 will continue progressing the same with each visa bulletin. Individuals who are now current should contact EIG to begin work on their Adjustment of Status case(s). If you already have an AOS pending with USCIS, it will not be adjudicated until the Final Action date becomes current.

USCIS reports that it has become necessary to retrogress the EB-3 final action date for India. India’s EB-3 number use has been consistently robust throughout the fiscal year, and it is estimated that applicants will use all EB-3 numbers made available to them during this fiscal year by the end of June. This situation will be continually monitored, and any necessary adjustments will be made accordingly.

The EIG team closely monitors changes to the monthly visa bulletin and determines the best action plan for each case. We will reach out to individuals whose priority date will be current next month to initiate the next step of the green card process.
