Judge Blocks Myanmar/Burma TPS Termination 

Judge Matthew F. Kennelly of the Northern District of Illinois temporarily blocked the Trump administration from terminating Temporary Protected Status (TPS) for Myanmar/Burma. 

  • The Trump administration announced it would end TPS for Myanmar/Burma last year; however, Judge Kennelly found that DHS did not appear to have met the procedural requirements to terminate TPS, as it did not review the country’s conditions in consultation with other agencies. 
  • The plaintiffs argued that the termination violated the Administrative Procedure Act (APA) and the Equal Protection Clause of the Fifth Amendment.
  • Judge Kennelly found that the plaintiffs were likely to succeed on their APA claim, but did not address their Fifth Amendment claims.
