Federal Appeals Court Clears Path for Termination of TPS for Honduran, Nicaraguan, and Nepali Nationals

On August 20, 2025, a panel of the 9th US Circuit Court of Appeals unanimously granted the Trump administration’s emergency request to proceed with ending Temporary Protected Status (TPS) for over 63,000 immigrants from Honduras, Nicaragua, and Nepal. The ruling overturns a lower court’s order that had temporarily blocked the termination.

Key Details of the Decision

The three-judge panel – comprising appointees from both Republican and Democratic administrations – issued a brief order allowing the Department of Homeland Security (DHS) to move forward with revoking deportation protections and work permits for TPS holders from the three countries. The court did not provide a detailed rationale for its decision.

TPS for Nepal expired on August 5, and protections for Honduras and Nicaragua are now set to end on September 8, barring further legal intervention.
