EB-5 Immigrant Investor Regional Center Program Expires

The EB-5 immigrant investor regional center program expired on June 30, but the lapse in authorization does not aect petitioners who are not seeking a visa under the Regional Center Program.

What to Expect
  • USCIS announced that they would reject Forms I-924 and Form I-526 received on or after July 1, 2021.
  • USCIS also announced that they would not act on any pending application or petition that is dependent on the regional center program.

Thousands of EB-5 applications remain in USCIS backlogs, and it is unclear what will happen to them. Since the program has expired, USCIS can’t issue green cards or approve pending applications.
