USCIS has released a series of Temporary Protected Status (TPS) updates affecting beneficiaries from Sudan, Somalia, and Ukraine. The announcements include automatic Employment Authorization Document (EAD) extensions for certain Sudanese and Ukrainian TPS holders, as well as confirmation that TPS protections for Somalia have officially terminated.
Sudan TPS: Automatic EAD Extension Through October 19, 2026
USCIS announced that Sudan’s TPS designation and related benefits are scheduled to terminate on October 19, 2026.
To avoid employment authorization disruptions, USCIS is issuing notices to eligible Sudan TPS beneficiaries who:
- Have pending TPS-based EAD renewal applications;
- Continue to qualify for TPS;
- Have not yet received a renewed EAD in category A12 or C19.
For these individuals, certain expired TPS-based EADs are automatically extended through October 19, 2026.
Eligible Sudan EAD Expiration Dates
Affected workers may use an EAD showing one of the following expiration dates together with the USCIS extension notice:
- November 2, 2017
- November 2, 2018
- April 2, 2019
- January 2, 2020
- January 4, 2021
- October 4, 2021
- December 31, 2022
- June 30, 2024
- April 19, 2025
Form I-9 and E-Verify Guidance
Employers should:
- Enter October 19, 2026 in the expiration date fields of Form I-9.
- Record the extension in the Additional Information field.
- Use October 19, 2026 as the expiration date in E-Verify.
Somalia TPS Officially Terminated
In a significant development, USCIS confirmed that TPS for Somalia terminated effective August 14, 2026.
The announcement follows prior DHS determinations that Somalia no longer meets TPS statutory requirements and references recent litigation developments following the Supreme Court’s decision in Mullin v. Doe.
Impact on Somalia TPS EADs
USCIS has stated that:
- TPS Somalia EADs issued under categories A12 and C19 are no longer valid.
- Employers must immediately review affected employees’ work authorization documentation.
- Continued employment is only permitted if the employee can present alternative proof of valid work authorization.
Employer Reverification Required
Employers must:
- Reverify affected employees using Form I-9 procedures.
- Obtain valid evidence of continuing employment authorization.
- Discontinue employment where no valid work authorization can be demonstrated.
This guidance supersedes USCIS’ August 12, 2026 Somalia TPS notice.
Ukraine TPS: Automatic EAD Extension Through October 19, 2026
USCIS also announced that TPS benefits for Ukraine are scheduled to terminate on October 19, 2026.
As with Sudan TPS holders, USCIS is providing automatic EAD extensions for certain beneficiaries whose renewal applications remain pending.
Eligible Ukraine EAD Expiration Dates
Eligible individuals may present:
- An EAD with an expiration date of October 19, 2023, or
- An EAD with an expiration date of April 19, 2025
together with the USCIS extension notice.
These documents will serve as List A evidence of identity and work authorization through October 19, 2026.
Form I-9 and E-Verify Requirements
For affected Ukraine TPS beneficiaries:
- Enter October 19, 2026 in Sections 1 and 2 of Form I-9.
- Add an explanation in the Additional Information field.
- Use October 19, 2026 as the expiration date in E-Verify.
