On July 27, 2026, USCIS has issued another round of Temporary Protected Status (TPS) employment authorization guidance, this time for beneficiaries from Burma (Myanmar), continuing a pattern of short-term extensions tied to ongoing federal court litigation.
The July 27 announcement supersedes USCIS guidance issued on July 17, 2026, and follows similar recent updates affecting TPS beneficiaries from Somalia, Syria, Haiti, Ethiopia, Yemen, and South Sudan.
As EIG recently reported in our coverage of TPS-related court orders and employment authorization updates, federal courts have temporarily delayed the termination of several TPS designations while lower courts consider the impact of the U.S. Supreme Court’s June 2026 decision in Mullin v. Doe.
Burma TPS: EAD Validity Extended Through August 3, 2026
According to USCIS, former DHS Secretary Kristi Noem previously determined that Burma no longer met the statutory requirements for TPS designation, and the designation was scheduled to terminate on January 26, 2026.
However, on January 23, 2026, the U.S. District Court for the Northern District of Illinois postponed the termination decision in Aung DOE et al. v. Noem et al., preserving TPS protections while litigation continues.
Covered EAD Expiration Dates
The court-ordered extension applies to Employment Authorization Documents issued under the Burma TPS designation with original expiration dates of:
- November 25, 2022
- May 25, 2024
- November 25, 2025
Updated Form I-9 Instructions
Employers completing Form I-9 for affected Burma TPS beneficiaries should:
- Enter “as per court order” in Section 1.
- Enter August 3, 2026 as the expiration date in Section 2.
- Add an explanatory note in the Additional Information field.
Updated E-Verify Instructions
For E-Verify purposes, USCIS instructs employers to use August 3, 2026 as the employment authorization expiration date when creating or updating cases involving affected TPS Burma beneficiaries.
