The US Department of Homeland Security (DHS) has announced that E-Verify services have resumed as of October 9, 2025, following a temporary system outage. Employers and employees must now take action to comply with updated deadlines and procedures.
Case Creation Deadline
- Employers must create an E-Verify case by Tuesday, October 14 for each employee hired while the system was unavailable.
- Use the hire date from Form I-9 when creating the case.
- If delayed due to the outage, select “Other” as the reason and enter “E-Verify not Available” in the text box.
Mismatch Resolution (Tentative Nonconfirmations)
If an employee received a mismatch and chose to contest it:
- Employers must revise the Referral Date Confirmation using one of three methods:
- Print a new notice with the updated referral date.
- Write the new date on the original notice after checking the case in E-Verify.
- Add six federal business days to the original referral date (excluding weekends and federal holidays).
For mismatches referred after October 8, do not add extra days.
Federal Contractor Guidance
- Federal contractors affected by the outage will not have lost time counted against their compliance deadlines.
- Contractors should contact their contracting officer for specific guidance.
Employee Instructions
Employees with mismatches must:
- Contact their employer to obtain a revised Referral Date Confirmation.
- Use one of the three methods above to determine the new deadline.
- Reach out to SSA or DHS by the updated date to begin resolving the mismatch.
For E-Verify+ cases, log back into the system to view the updated “What’s Next” screen for your new action date.
