August 2024 Visa Bulletin Released

In the August 2024 Visa Bulletin, Final Action Dates for Worldwide (All Other) EB-1, EB-2, and EB-3 remain the same.  Final Action Dates for EB-1 remain the same, and EB-2 and EB-3 India advance. EB-1, EB-2, and EB-3 China remain unchanged.

PLEASE NOTE: USCIS has not indicated if they will accept adjustment of status applications pursuant to Final Action Dates (Chart A) or Dates of Filing (Chart B) for the employment-based preference filings. For more information, please visit the USCIS website.

Final Action Dates (Chart A)

China:

  • EB-1: Remains unchanged with a cut-off date of November 1, 2022.
  • EB-2: Remains unchanged with a cut-off date of March 1, 2020.
  • EB-3: Remains unchanged with a cut-off date of September 1, 2020.

India:

  • EB-1: Remains unchanged with a cut-off date of February 1, 2022.
  • EB-2: Advances 1 month with a cut-off date of July 15, 2012.
  • EB-3: Advances 1 month with a cut-off date of October 22, 2012.

Others:

  • EB-1: Current for all countries except China and India.
  • EB-2: Worldwide (All Other) remains unchanged with a cut-off date of March 15, 2023.
  • EB-3: Worldwide (All Other) remains unchanged with a cut-off date of December 1, 2021.
Dates for Filing (Chart B)

China:

  • EB-1: Remains unchanged with a cut-off date of January 1, 2023.
  • EB-2: Remains unchanged with a cut-off date of June 1, 2020.
  • EB-3: Remains unchanged with a cut-off date of July 1, 2021.

India:

  • EB-1: Remains unchanged with a cut-off date of February 8, 2022.
  • EB-2: Advances 1 month with a cut-off date of July 22, 2012.
  • EB-3: Advances 1 month with a cut-off date of November 1, 2012.

Others:

  • EB-1: Current for all countries except China and India.
  • EB-2: Worldwide (All Other) remains unchanged with a cut-off date of March 22, 2023.
  • EB-3: Worldwide (All Other) remains unchanged with a cut-off date of February 1, 2023.
Looking Forward

Individuals who are current should contact EIG to begin work on their Adjustment of Status case(s). If you already have an AOS pending with USCIS, it will not be adjudicated until the Final Action date becomes current.

The EIG team closely monitors changes to the monthly visa bulletin and determines the best action plan for each case. We will reach out to individuals whose priority date will be current next month to initiate the next step of the green card process.

Looking ahead, we are closely monitoring the visa availability in the Employment-Based Third (EB-3) preference category. As highlighted in the July 2024 Visa Bulletin, sustained high demand may necessitate adjustments such as retrogression of final action dates or category unavailability starting September.
