The PERM process is multi-step and involves very specific instructions from the Department of Labor. Through the PERM process, an employer represents to the Department of Labor that it has conducted a good faith test of the local labor market, and has not found any U.S. workers able, willing, qualified, and available to accept the job opportunity in the area of intended employment.

EIG attorneys supervise each step of the PERM process to ensure accuracy and mitigate audit risks. At the outset, an EIG Attorney works with the employer and employee to define the job duties and actual minimum requirements for the position. An EIG attorney then works directly with the foreign national worker to obtain the documentation necessary to show he/she possesses the minimum requirements for the position. EIG’s in-house PERM recruitment team files the prevailing wage determination (PWD) and conducts recruitment under the supervision of the attorney.  All steps are carefully reviewed before submission of the PERM application.
