The United States | On Friday, New York federal judge Nicholas G. Garaufis ordered the Trump administration to fully reinstate the Deferred Action for Childhood Arrivals (DACA) program on the basis that the acting Department of Homeland Security chief Chad Wolf did not have the authority to change the program in the first place.

“Accordingly, because Mr. Wolf was without lawful authority to serve as acting secretary of DHS, the Wolf Memorandum is vacated,” Judge Nicholas G. Garaufis said. “In light of the vacatur, all parties agree that the DACA program is currently governed by its terms as they existed prior to the attempted rescission of September 2017.”

The DACA program provides deportation relief and work permits to individuals brought to the US as children.

Judge Garaufis’s ruling follows a Supreme Court ruling in June to preserve the program. DACA and its beneficiaries have been under scrutiny throughout the Trump Administration.

The Immigration Nerds bring to the podcast a panel from the recent SHRM Global Mobility and Immigration Symposium, “The Stable Triangle: Driving Employee Experience with Coordinated Immigration, Tax, and Relocation.”

EIG Managing Attorney Salman Cheema and Lieselot Whitbeck, Hunton Andrews Kurth, discuss the increased demand for integrated service to make an employee’s transition a simpler, streamlined process that recognizes and accounts for the unique circumstances of their family. For global mobility professionals, this requires coordination between several different service providers. When immigration, tax, and relocation teams work together, facilitated by in-house global mobility, employees (and their families) feel cared for and supported through one of the biggest changes in their personal and professional life with the result being a focused, engaged, and retained employee and family.
