New DACA Applications May Be Accepted in a Few Months

A US District Court judge in Washington, DC ruled on April 24 that the Deferred Action for Childhood Arrivals (DACA) program cannot be phased out, but the decision has been delayed for 90 days to allow the Department of Homeland Security (DHS) to respond. This month’s lower court decision echoes two previous lower court injunctions from New York and California, but went further in mandating that DHS “must accept and process new as well as renewal DACA applications.” This would be welcome news to undocumented immigrants who otherwise qualified for the DACA program but were unable to apply, as new applications have no longer been accepted since March.
