USCIS Expected to Reopen FY21 H-1B Lottery

On Monday, August 10, multiple sources close to USCIS began reporting that the agency would reopen the FY 2021 H-1B lottery due to lower than expected filing numbers of the cases initially selected back in March. USCIS is believed to have conducted a second lottery of the cases registered in March, not initially selected.

We anticipate that USCIS will make an announcement this week, and will electronically notify attorneys and company agents of the cases that have been selected in the second lottery. Once EIG is notified of the cases that have been selected in the second lottery, we will notify all appropriate parties and stakeholders, and begin preparing H-1B cap petitions for the selected individuals.

Once USCIS makes an official announcement, we will send an additional client alert.
